Ioanna Gaka and Elias Theodoropoulos, the two doctors who were remanded in custody for the death of Giorgos Mazonakis at the age of 54 during plasmapheresis at their clinic in Kolonaki, were taken to Korydallos prison early Thursday morning.
The operation to transfer Ioanna Gaka began shortly after 6:30 from the Kypseli Police Station where she was held after her pretrial detention approximately 24 hours ago, following her long apology.
A few minutes later, the car that transported Ioanna Gaka to Korydallos passed the prison gates to begin her pretrial detention.
Her husband and also a remand prisoner, Elias Theodoropoulos, who spent the night at GADA, left the back door of the police headquarters on Alexandras Avenue shortly before 7 in order to be transferred to Korydallos prison.
The prison sentences were issued at noon on Wednesday with the two defendants being prosecuted for the felony of homicide by intent with possible malice, committed by omission, after the initial indictment was upgraded from the fatal exposure.
Alarms, delay in emergency services and inability to provide assistance
Particularly aggravating, according to the rationale for the temporary detention, are what happened after the singer's condition began to deteriorate.
The investigator and prosecutor attribute to the two defendants acts and omissions related to the loss of human life, while their reaction to the warnings of the plasmapheresis machine was specifically examined.
According to the information included in the reasoning, the alarms signaled a serious deterioration in Mazonakis' condition, however the plasmapheresis process reportedly continued.
At the same time, particular importance was attached to the delay in calling the emergency services. The judicial authorities allegedly ruled that the doctors did not call an ambulance in time, without providing sufficient justification for the delay, while at the same time, according to the reasoning, they were not in a position to offer the necessary assistance to revive the singer from his coma.
The decision also mentions that the two doctors performed serious medical procedures in a place without the required license and without the appropriate equipment, but also without having previously, according to the same reasoning, carried out the necessary examinations of the patient.
The judicial authorities also reportedly believe that there were actions that hindered the further investigation of the case and concealed evidence, an element that was taken into account in the decision on temporary detention.
They will challenge the temporary detention order
It is noted, however, that according to a statement by the lawyers of the two doctors, they are expected to appeal their temporary detention order, noting that "the procedural rights of their clients have been brutally abused."
In detail, the announcement:
"The Law Firm "Nikos Agapinos and Associates", following the expected development in relation to the procedural treatment of its clients, Elias Theodoropoulos and Ioanna Gaka, as a result of the completely unjustified upgrade of the charge, announces that it will immediately challenge the temporary detention order at the competent Council, as it believes that the procedural rights of its clients have been brutally abused."
