With a new letter, the five municipal councilors of Deryneia returned, asking for a decision from the Municipal Council that will determine the future of the Municipality in terms of mergers.

The Municipal Councilors Annita Lili, Loukas Polykarpou, Christos Tofias, Nikos Charalambous and Andreas Grigoriou sent a reply letter to the letter sent on November 30 by the Mayor of Deryneia with a legal opinion in which he could not explain to the council the associations for the reform of the local self-government.

The new letter sent by the five municipal councilors to the Mayor of Deryneia asks the following:

  1. Since in the opinion of you and the legal advisor, the Municipal Council is not legitimized to decide on issues of mergers, why then have you become a brilliant preacher of the merger of Deryneia with Frenaros and Acheritos?
  2. If it does not fall within the responsibilities of the Municipal Council, then by virtue of which decision of the Municipal Council do you allegedly reside throughout Cyprus the supposed will of the citizens of our city?
  3. Since it does not fall within the responsibilities of the Municipal Council, how then did you prepare or secure an "report" or a "study" that justifies the merger with Frenaros and Acheritou?
  4. By what decision, what approval and what authority (and who will pay the costs) did you outsource a legal opinion on whether or not the city council can make such decisions?

According to his provisions Article 5 of the Pre-Municipalities Law:

"The minister at the request submitted to him by the authority of any local government unit or as long as he wished he deemed desirable the merger of such a unit of local administration with a neighboring municipality.

In addition to and in parallel with the above provision, in accordance with the provisions of the Law on Municipalities:

"The Council of Ministers can at the request of the local authorities concerned and after hearing their views, by decree published in the Official Gazette of the Republic, to redefines, modifies, expands or limits the municipal boundaries of a municipality established on the basis of the provisions of this law. ”

For both of the above legislative provisions, it is the Municipal Council that takes the relevant decisions to proceed with the respective applications.

Please remind the Legal Adviser of the Municipality of the above legislative provisions and powers of the Municipality, which he did not include in his opinion.

In addition to the above, the bill under discussion that is in the House of Representatives, will effectively repeal the Law on Municipalities and the powers contained in it and will be replaced by new legislation. The same law that leads to repeal, misinterpreted by you or your legal adviser, you project as a shield to avoid discussion. Consequently, it is a historical obligation and duty of the representatives of the people of Deryneia, ie the Municipal Council, to take and announce their positions and decisions for the future of their place and not to resort to legal tactics.

The will of the people of Deryneia is expressed through its Municipal Council. A Council to which you have often referred with the aim of making a decision on the issue of restructuring, the taking of which you canceled because you realized that it would be contrary to your personal views.

In view of the most expressed position of the majority of the Municipal Council, which opposes the contracting effort, in order to serve party interests, unification only with the communities of Frenaros and Acheritos, you are called to refrain from any efforts that oppose the decisions and positions of the majority.

You have every right as Mayor to democratically express your personal views and opinions. On behalf of the Municipality of Deryneia, however, and without the prior decision of the Municipal Council on the issue, you do not have the right to transfer to the decision-making centers any suggestion or opinion of the Municipality.

"Paper War" for mergers - "No" Karagianni at a meeting

It is recalled that the "no" of the Mayor of Deryneia to convene a meeting to discuss the much-praised issue of local government reform five of the nine members of the Municipal Council of Deryneia, which in signed letter on November 25, 2021 requested the convening Extraordinary meeting for discussion of the proposed bill for reform of local government in order to take a decision as was done in the other Municipalities of free Famagusta.

At the same time, Mayor of Deryneia states in his letter that "At a meeting of the Municipal Council on November 24, 2021, I could put the issue to a vote taking advantage of the absence of a member of the Municipal Council, but within the framework of fellowship and my constant desire for as much as possible taking unanimous decisions of the Municipal Council, I did not put it to a vote. ”

He also states that has no power to discuss this issue and will not convene a session, warning that if the other members of the Municipal Council (who constitute the majority) convene a meeting, then it will be considered illegal and invalid and will not be recorded in minutes nor will it be considered a session.
