The Administrative Court yesterday upheld the appeal of OSEA Famagusta against the decision of the Ministry of Transport, to assign public transport in the province of Famagusta for the period 2020 - 2030 to the consortium Malta Lines - Kapnos Shuttle.
The Court found in one of the eight grounds of appeal that the Contracting Authority of the Ministry of Transport was mistaken in accepting, after clarifying questions during the evaluation of the tenders, that the business-financial plan of the consortium included in its tender was ratified. by an audit firm or auditor, with the qualifications and professional certifications required by the tender notice.
It therefore canceled the decision of the ministry to assign the project of public transport to the consortium for the period 2020 - 2030.
It is expected that based on the decision, the Tender Board will meet again to take new decisions based on the court decision. The public transport for the next decade in the province of Famagusta was claimed by the consortium Malta Lines - Kapnos Shuttle and OSEA.
It should be noted that the same ground for annulment had been raised by OSEL in its action against the public transport consortium in the province of Nicosia, however the Court accepted that because OSEL did not meet this requirement, it would not consider the matter, so and the bid was awarded to the consortium.
In its own decision yesterday, the Administrative Court rejected the parallel appeal that it considered, that of "Zenon" Larnaca against its exclusion from the claim of public transport in the province of Larnaca. The appeal challenged the exclusion of "Zenon" by the Contracting Authority because the company did not have the required experience in bus telematics systems.
The ten-year contract for the province of Larnaca was claimed by "Zenon", OSEL, a Milan bus company with Cypriot bus operators and the Malta Lines - Kapnos Shuttle consortium. The Ministry of Transport has decided to assign the Malta Lines - Kapnos Shuttle consortium. Prior to the rejection of an appeal by "Zenon" for Larnaca, an appeal was rejected by OSEL.
The decision in the existing contractor Intercity against the decision of the Ministry of Transport to award the contract 2020 - 2030 also to the consortium Malta Lines - Kapnos Shuttle is now pending in the Administrative Court.
