Withdrawal of a suspension order from the Court

The Tourism Center secured a license from the Ministry of Tourism, in which the District Court of Famagusta issued a temporary decree on June 9 suspending its operation, at the request of the Police.

Today, the Court of Appeals ruled in favor of the appeal filed by the owners of the leisure center in the free area of ​​Famagusta, regarding the validity of a temporary decree suspending its operation.

However, today the lawyers of the owners presented to the Court the operating license provided by the Ministry of Tourism, with the result that the temporary decree suspending the operation of the center was canceled and this is now operating normally.

According to KYPE, the request of the Police for temporary suspension of the operation of the premises was based on the Law on the Operation of Recreation Centers and not on the Law on Infectious Diseases, which does not provide the Government with power to request the suspension of a non-existent property.

As for the nine cases in total that the Police filed on June 9 before the District Court of Famagusta, against the owners of the leisure center, they will be examined at a later stage.

It is noted that five of the charges relate to offenses in violation of the Law on Infectious Diseases and four cases concern the operation of the property without a license from the Ministry of Tourism.

It is recalled that according to a letter sent by the Municipality of Paralimni to the Police on June 9, 2020, it informs that the property had a license to operate a restaurant and a license to sell alcoholic beverages from June 6, 2020.
