Guilty Chr. Orphanides and his wife for unsecured checks

The Court of Appeals today found the businessman Christos Orfanidis and his wife Hariklia guilty in a case of issuing two unsecured checks totaling € 20.000. The two checks were issued to the company Savvas Theocharous and Son Ltd. in November 2012 and concerned one issued by Chr. Orfanidis amounting to € 10.000 and another by his wife also amounting to € 10.000.

The company brought before the District Court of Famagusta, a private criminal case against the company Orphanides, as a legal entity and the businessman Christos Orphanides and his wife, as natural persons.

The two defendants were acquitted at first instance, while the Orphanides company was found guilty and fined. The reasoning of the decision of the District Court stated that the Orphanides were not aware of the situation of their bank account from which they issued the said checks.

The company Savvas Theocharous and Son Ltd filed an appeal against the acquittal of the two.

In its decision, the Court of Appeals ruled that at the time when Christos and Hariklia Orphanides were issuing the disputed checks, they knew or should have known that the balance of their account since he had a large excess.

The Court of Appeals will impose a sentence on the Orphanides on November 24.

This is the first conviction against Christos Orphanides himself.
