The allowance they received, since 1996, which is the year of his birth, as a permanently incapacitated person, was decided to be cut by the competent services. The termination of the benefit was decided in 2014, because it has been established that the beneficiary of the aid, "does not have his legal and usual residence in the areas controlled by the Republic of Cyprus".

As can be seen from the content of the decision of the Administrative Court, the family was monitored by a Social Services official. During the visit of the officer, which took place in May 2014, it was found that the child was with his mother in Chania, Crete, where he attended a Special Vocational Education and Training Laboratory where specialized courses, physiotherapy, occupational therapy, other speech therapy services were provided. and activities. The official found that the foreign caregiver, who had been approved to meet the child's care needs, was staying at the grandmother's house, which she was serving.

The official made another visit two months later. The mother of the child told the minister that their move to Crete was for the purpose of educating her son, due to the health problems she was facing, as even though she was 18 years old, she could not support herself. She also mentioned that in Crete they lived in a rented house and she was facing financial difficulties, not only because of the cost of rent, but also the cost of care she had in Crete. Finally, she stated that in Cyprus the places that had been offered for her child to attend were institutions for people with serious health problems and the case of her child did not fall into them.

The Court ruled that the competent services were erring in the provisions of the law, considering that because the child was in an educational institution outside Cyprus, he did not have his usual residence in the Republic, as a result of which he did not meet the relevant criteria for assistance. He further considered that the research that led to the termination of the allowance was incomplete, as it did not take into account, among other things, "the positive results that education in Chania could bring to a special school, which could provide him with to help him get rid of some of the public aids… ».
