His father, Brandon Kervera, is charged with the child's death. Videos were played in court where in one of them, little Benjamin can be heard saying: "Daddy, daddy, can I have a piece of bread?"

A few days later, on August 17, 2021, the child cooled down.

As KSAT channel reported, the 4-year-old was begging his father for bread, water or milk before telling him in the video "I want some bread."

In the video, the child, joining his little hands to his chest and with trembling legs, begs his father for some bread.

However, this is not the only video, but 30 similar videos were found on his stepmother's cell phone and from cameras.

In some of them, the little boy is seen searching through the night in cupboards and the fridge for food, while in another video the 4-year-old is visibly beaten.

The medical examiner described that the child's injuries were not consistent with the resuscitation effort as claimed by the father.

The father is believed to have locked the cupboards to prevent the toddler from finding food.

The child's stepmother would send messages to the father that Benjamin was asking for food and he would respond by not giving him dinner or just giving him some bread.

For their part, the 31-year-old's advocates argue that it is incorrect to refer to starvation as the cause of the child's death, accusing the prosecution of an attempt to mislead.
