A new case of sexual abuse of minors is coming to light. The case was uncovered last Friday when the Criminal Court found a man guilty in a series of charges involving harassment of minors. The minors revealed the horror they experienced next to him when they became adults.
The history
According to the findings of the Court, F.X. (M.K.1) was born on 27.1.1986 and is the son of MK.5, half-sister of the accused. AJK (MK.2) was born on 9.1.2000 and is the son of MK11, the sister of the accused. Both complainants, at various times during their childhood, had frequent contact with the accused.
M.K.1, during the period beginning in 1995, ie from the age of 9, lived on various weekends at his grandfather's cottage in Maroni, in the same bedroom as the accused.
In the circumstances that MK.1 described in his testimony and are mentioned above in this decision, MK.1 suffered what he also described in detail in his testimony, by the accused.
MK.1 never revealed the above until after many years. Around the year 2010, on the occasion of information of the attack of the accused in MK.8, his mother, MK.1 could not bear it and revealed the abuse he had suffered to his family members, asking them not to say anything.
For his part, MK.2 used to stay at his grandmother's house in Nicosia, where the accused also lived, over the weekend, in a separate room with his brother. From September 2006 to 2009, MK.2 suffered what he described in detail in his testimony.
M.K.2 did not reveal anything to anyone, except for the year 2015 3 approximately, when he revealed the abuse he had suffered from the accused, to his classmate and friend, MK.4. In August 2018, under the circumstances he described in his testimony, he revealed the abuse, without details, to his mother and brother (MK 11 and 13). As a consequence of his abuse by the accused, MK 2 suffered a severe anxiety disorder, and in three different cases tried unsuccessfully to end his life. Now aware of what the accused did to the detriment of both of them, MK.1 and 2 decided to report the accused to the Police, something they did in January 2019. The case was set for the purpose of mitigating and sentencing on 7.12.2021.
The categories
On 26.11.2021, following a hearing, the Permanent Criminal Court of Nicosia found guilty the accused in the case no. 212/2019, in the following categories:
- Six categories of sexual exploitation of a minor in violation of articles 2, 3 (1) (c) (2) (b) and 6 of the Law on Combating Trafficking in Persons and Sexual Exploitation of Minors Law 3 (I) / 2000 (categories under Nos. 1, 3, 5, 8, 11 and 14),
- Nine charges of indecent assault against a man in violation of Article 152 of the Penal Code Chapter 154 (categories no. 2, 4, 6, 9, 12, 15, 18, 21 and 24),
- Seven categories of intercourse with a young man under the age of thirteen in violation of Article 174 (1) of the Penal Code Chapter 154 (categories no. 7, 10, 13, 16, 19, 22 and 25),
- Three categories of sexual exploitation of a child in violation of articles 2, 10, 12, 16 and 17 of the Law on the Fight against Trafficking and Exploitation of Persons and the Protection of Victims Law 87 (I) / 2007 (categories no. 17, 20 and 23).
- Two charges of indecent assault against a man in violation of Article 152 of the Penal Code (charges no. 26 and 27). 2 Categories 1 - 24 concern AJK (M.K.2), aged 6-9 years at the time of the commission of the offenses, while categories 25 - 27 were directed against F.X. (M.K. 1), who at the time in question was under thirteen years of age.
