ΑA father requesting that his two children be allowed to be vaccinated against coronavirus, despite their mother's objections, was rejected by the Paphos Court.
According to a publication of "Phileleftheros", this is the first case of this nature to reach the Courts and concerns the vaccination of children, with conflicting positions of their parents.
Regarding the vaccinations of minors 12 years and older, it should be reminded that they are allowed, but only with the consent of both parents.
In the case in question of the applicant, according to "F" he agreed to vaccinate his two children over the age of 12, but the mother did not give her consent.
The Court yesterday in its decision noted that no testimony was presented to him in the context of the procedure, which would allow him to safely conclude that the vaccination of these minors will be in their interest. "I point out that the Court cannot make itself an expert on medical matters," he stressed, which is why he rejected the request.
It becomes clear that if there was a medical opinion on the matter and after hearing the pros and cons, the Court would have a better opinion, as was done with lawsuits filed in Citizens, against the measures, the application of SafePass etc.
The specific application of the father was registered on 3/8/2021 in a Court in Paphos, and with this the applicant requested the issuance of the following decrees:
A. Decree of the Court allowing the minor daughters of the parties to leave Cyprus and to travel with their father - applicant abroad.
B. Order of the Court authorizing the underage daughters of the parties to be vaccinated against coronavirus (Covid-19) without the consent of their mother.
With regard to the issue of vaccination, the requesting father had argued in court, inter alia, that his two underage daughters wished to be vaccinated against the coronavirus and although he agreed, the defendant disagreed. He also stated that he sincerely believes that, based on the recommendations of the World Health Organization (WHO) and the European Medicines Authority (EMA) and the decision of the Council of Ministers of the Republic of Cyprus dated 29/7/2021 for vaccinations against the disease Covid-19 of children 12 years of age and older, it is in the best interests of minors' health and interest to receive the vaccine and to protect themselves from the disease.
Regarding the request to be allowed to travel abroad with his two daughters, since their mother does not give her consent, he claimed that their grandmother who lives abroad is ill and that they themselves want to have ties. with relatives in their father's country of origin.
The ex-wife, on the other hand, argued in the Court of diametrically opposed positions, that is, it is not in the interest of minors to travel in such a period, where the pandemic records high rates of positive cases with coronavirus disease. It will put them at increased risk of getting sick, self-limiting or even missing the first few days of the new school year.
He also argued that minors want to be vaccinated against coronavirus Covid-19 adding that vaccinating them would not be in their interest. He therefore referred to the advice of their doctor for possible effects on their health.
