Giannakis continues to be paid - The Auditor General demands compensation

The Auditor General, Odysseas Michailidis, sent a letter to the Cyprus Youth Organization regarding the possible commission of the forgery offense by the former Commissioner for Volunteering.

According to a publication by Phileleftheros, the Auditor General suggests the imposition of mandatory retirement on the former Volunteer Commissioner, Giannakis Giannakis, as well as the launch of a compensation claim.

Odysseas Michailidis noted in his letter that Mr. Giannakis still receives 50% of his salary, something that can continue for a long time, since the case is before the District Court and the process can take several years. during which Mr. Giannakis will continue to receive 50% of his salary.

"Unless you make another decision in the meantime, the former Commissioner will continue, perhaps for some more years, to be paid 50% of his salary," the Auditor General notes. Having indicated that according to the ONEK Regulations (On the Organization of Youth (Structure and Terms of Service of Employees) Regulations (KDP 513/2007), if criminal proceedings are instituted against an employee, no disciplinary proceedings are allowed to be instituted or to be continued ( related to the criminal prosecution, until it reaches a final end), the Auditor General points out: , in case of even unnecessary unfitness of an employee, who is obviously presumed if, for any reason (unnecessarily or fraudulently), he does not fulfill the current Service Plan of the position ".

It is therefore our view, the Auditor General continues, "that it is not appropriate for you to remain inactive and that you should seek legal advice, preferably from at least two reputable legal advisers, who will advise you on your best legal handling, so that to safeguard the interests of ONEK ".

The letter adds, that "in the context of the same legal guidance, you should, in our view, initiate the procedure for seeking civil damages if, regardless of the conviction or not of the former Commissioner for Volunteering for any criminal offense, you can find that he he is not the holder of the qualifications that would justify his remuneration with a salary paid to a holder of a university degree ".

The Auditor General also suggests that legal advisers should comment in particular on the issue of the possible statute of limitations of any civil offenses under the Law on Limitation of Inviolable Rights (Law 66 (I) / 2012).
