US: Texas Reintroduces Abortion Prohibition Act

It entered into force on 1 September

The New Orleans Federal Court of Appeals has allowed Texas to reinstate a controversial law that prohibits the majority of abortions in this US state.

This law, which came into force on September 1, prohibits abortion as soon as the heart of the fetus is heard, ie around six weeks of pregnancy, when the majority of women are unaware that they are pregnant.

This law does not provide for exceptions for pregnancies resulting from rape or incest. It also allows ordinary citizens to enforce the ban, providing for a fee of at least $ 10.000 if they succeed in suing anyone who helped have an abortion after a heart attack.

Critics of the law complain that this provision of the law allows people to act against abortions as hunters of bidders.

The law was temporarily suspended on Wednesday following a decision by a Texas federal judge, following an appeal by the government of US President Joe Biden.

Judge Robert Pittman in Austin had temporarily suspended the Texas abortion law while the lawsuit was still pending.

The US Department of Justice has argued that the law prevents women from exercising their constitutional right to terminate a pregnancy, which was recognized by the Supreme Court in 1973 in the Rowe v. Wade case, which ruled that abortion was legalized at national level.
