Mammoth compensation was recently awarded by a court in Larnaca in a lawsuit filed against the Republic by a young man who became mentally disabled after suffering a heat stroke while serving in the National Guard.

A judge awarded a total of € 2.000.000 in damages to 26-year-old (today) Neophytos from Lympia, who after the incident remains disabled and completely dependent on others. The decision of the Court also shows the alalum in the decisions of the National Guard on issues of handling a special category of soldiers.

As it turned out, while the affected soldier was classified in category I4 due to obesity, nevertheless, despite the orders, he performed exercises and took part in the rehearsals of the parade during the swearing-in. Also, while there was a signal from GEEF due to high temperatures to limit the exercises, however they continued with only restriction at the end of the lunch program.

As the court points out emphatically, while he should not have taken part in exercises and rehearsals of the parade as the standing orders of the Armed Forces, however, he took part following the orders or orders of senior soldiers, resulting in heatstroke due to his stress. Neglect is also found for the fact that while he vomited and lost consciousness, he was not transported in time to the Hospital next door but several hours later.

According to the decision of the senior district judge N. Gerolemos, an amount of € 800.000 is awarded as general compensation for pain, suffering, suffering and loss of personal comfort, another € 800.000 as general compensation for care and restoration and another € 400.000 as loss of future earnings .

Neophytos had enlisted in the National Guard in July 2007 and 22 days later while he was in KEN Larnaca he suffered heatstroke, as a result of which he has been stuck with 100% disability ever since. He was initially taken to the camp clinic, later to Larnaca Hospital and due to the criticality of his condition in Israel, at the expense of the state, where he remained for two months.

As it turned out, although he was judged by the I4 army, he performed exercises and took part in the rehearsals of the parade. On the day he suffered the heatstroke, very high temperatures prevailed, in Nicosia they did not reach 43,5 degrees.

As emphasized by the Court, “the effects on Neophytos on his physical, mental and mental health were literally devastating. While he was a healthy young man of 18 years with a source smile, with all the future in front of him, he became completely dependent on others, with an inappropriate smile and was deprived forever of every opportunity to live like other young people.

The possibility of improving his condition is minimal to non-existent and there is, I would say, no possibility in this direction. Any support from his various therapists is aimed at maintaining his condition. Every expectation or even dream is no longer a part of his life.

The complete lack of any hope for a love life, family creation, work and everything else that any other person of his age has, is not only certain but also eternal. "Neophytos is alive but without life", the judge emphasizes.

As pointed out in the award of damages, "the pain, suffering, which includes the mental pain he will have until the end of his life, the suffering, the bodily injuries he suffered, the consequences and the remnants of those he suffered Neophytos, his inability to work, that he will not have a family, that he will not taste the joys that, if this did not happen to him, he would have like any other young man of his age, with a disadvantaged position that he feels and is and everything else he has suffer, I consider that the award of the amount of € 800.000 for pain, suffering, suffering and loss of personal comfort, as general compensation is in the circumstances fair and reasonable ".

The largest compensation…

It is the first time in the Cypriot data that such large damages are awarded by a court. Previously large compensation concerned the death of a 56-year-old lawyer in Larnaca that amounted to € 800.000.
