The well-known lawyer Achilleas Dimitriadis, with many years of experience in property issues of the occupied territories, presented unshakable evidence that the allegations of the Turkish side are not true. The second important issue raised by him is the way the people of Famagusta themselves react to what is provocatively supported in the occupied territories.

Mass appeals

At a time when the illegal regime of the occupied territories seems to be preparing to make moves with the closed city of Famagusta, but also the allegations of possession of titles that show, according to the Turkish side, that EFKAB is the owner of property inside the closed city, Mr. Dimitriadis puts on the table the mass reaction of Famagusta residents by appealing to the Committee on Real Estate Occupation of the Occupied Territories. Specifically, Mr. Dimitriadis proposes that E / K property owners, within the city of Famagusta, appeal to the Committee of the Occupied Territories in response to a possible opening of the fenced city. The appeal, as he clarifies, will concern exclusively the requirement for restoration and for loss of use from 1974 until today. In this way, Mr. Dimitriadis argues, the Turkish side will be forced to restore these properties to its owners without being able to do anything else.

State assistance

According to figures released by the Occupied Territories Commission, of the approximately 6 appeals before it, 500 relate to the property of the fenced city. The reactionary framework that Mr. Dimitriadis puts on the table, provides for the timely preparation of the E / k owners, if and when the Turkish side implements the threats for opening the city under T / C administration. Here, Mr. Dimitriadis asks for state aid in order to assess the value of the specific properties. It is important, the state notes, to submit the Cadastral estimates for this property that is in the fenced city. The Turkish side presents the values ​​of the fenced city much lower than those calculated in the free areas. "And the reason is that we rely on the prices of the free zones and they rely on the prices of the occupied territories," he added.

Half a million pounds

A third element that refutes the Turkish claims for property rights has to do with the ECtHR and its decision in the Xenidis Aresti case. Explaining the legal dimension of the whole issue, Mr. Dimitriadis reminded that the ECtHR rejected EFKAB's claim that its property belonged to Aresti. According to Mr. Dimitriadis, this decision is doomed. Since then, as he added, the Turkish side has corrected its narrative and has taken proceedings in the occupied territories, EFKAB against the subordinate administration where it allegedly says that it has a court decision that finds the ownership of EFKAB for the fenced city. Of course, we do not accept these, he noted.
