EBE Famagusta is promoting an amendment to restore injustice to refugees

The Chamber of Commerce and Industry of Famagusta (EVEA), noticing the timeless injustice against the refugees regarding the non-issuance of a certificate of declaration (real estate) after the death of a legal or natural person to his heirs, proceeded to the following actions:

  • Legal advice was sought from the former President of the Supreme Court of Cyprus and our distinguished fellow citizen, Mr. Akis Hatzihambis, who, after thoroughly studying the current legislation, made a proposal to amend it, so that this timeless injustice would be restored.
  • He pledged to promote the amendment bill drafted by Mr. Hatzihambis to all parliamentary parties, with the request that it be discussed and voted on by Parliament.
  • Put the legal expertise of Mr. Hadjihambis at the disposal of all those who might want to use it.

The amending law proposed to be submitted to the House of Representatives for voting is attached below:

PREFECTURE THAT CHANGES THE NON-PRODUCTION OF CURRICULUM VITAE OF SECURITY AND MAINTENANCE (PROVIDED PROVISIONS) LAW

The House of Representatives votes as follows:

  1. This Law will be referred to as the Provincial Cadastral Cadastral Offices of Famagusta and Kyrenia (Provisional Provisions) (Amending) Law of 2019 and will be read together with the Provincial Cadastral Offices of the Famagusta and Purchases (1984) (Provisional) will be referred to as 'the basic law') and the basic law and the present Law will be referred to together as the Laws of the Provincial Cadastral Offices of Famagusta and Kyrenia (Provisional Provisions) Laws of 1986 to 1984.
  1. Article 10 of the Basic Law is amended by the addition of the following new paragraph.

(4) With regard to the validity of Article 5 of a declaration of a person, natural or legal person, having an interest in real estate as a beneficiary of a contractual right of non-constituent real liability or right within the meaning of Article 5 (1) (b) and by which, therefore , the Director shall not issue a certificate of registration under Article 10 (1), the Director shall issue a certificate of certification of that declaration. In the event of the death of the natural person in question or the dissolution of the said legal person, the Director shall provide the relevant details of the management or dissolution, and issue a certificate of that statement to the administrator and / or the heirs of the natural person. their status as heirs substituted in his statement or in the administrator and / or the beneficiaries of the legal person in their capacity as dissolving substitutes in his statement '.
