The death of a 29-year-old pregnant woman in Paralimni due to medical negligence

The family from the first moment disputed the cause of her death, as stated by the doctor and the managers of the clinic where the events took place.

Following a death investigation hearing, which lasted more than two years and was represented by lawyers, both the family of the deceased and the doctors involved in the Private Clinic and the gynecologist in charge, the Court came to a conclusion that justifies the family of the deceased. for which the law firm Theofanis Andreou and associates appeared.

According to the conclusion of the death investigation, the death of the 29-year-old mother came from uncontrollable bleeding, which was caused during the delivery by caesarean section in the operating room of the Polyclinic on 17/11/2010.

The bleeding was caused, as mentioned in the conclusion of the death investigation, due to the severe form of epicardial placenta. This uncontrollable bleeding triggered Diffuse Intravascular Coagulation, which is the result of uncontrolled uncontrolled bleeding, as blood coagulation factors change. In turn, Diffuse Intravascular Coagulation eventually led to cardiac arrest and death, the finding added.

It also states that "there is a suspicion of third party liability for causing death and in fact it is clear that there is a crime of negligence to which death is attributed."

The doctors involved in the clinic tried in vain to hide the real facts with various vague and non-existent allegations, which are refuted by the necropsy itself and the histopathological examinations, the report still states. In fact, there is a description of an incident, during which seconds after the fatal for Elizabeth, the on-duty staff of the clinic asked her husband if he was willing to sign for her mother to have her organs removed.

Elizabeth's family lawyer used the services of a Professor of Obstetrics and Gynecology at the University of Patras to support his legal position that the 29-year-old mother died of medical malpractice.

The Court, specifically in the conclusion of the death investigation, makes an extensive reference to the testimony of the Professor of Obstetrics and Gynecology of the University of Patras and Director of the Obstetrics and Gynecology Clinic of the University, Dr. Georgios Kourounis, who was categorical and clear.

In particular, he stated that "all the doctors involved did not correctly or at all assess the obvious risk of death and prepared the surgery and themselves for a routine caesarean section, while the pregnant-deceased condition with specific things, such as her admission to organized surgeries with direct access to blood, two venous blood supply routes and many more that did not happen. "Also, his position was that the uterus of the deceased should be removed in time to stop the bleeding and not after her death."

In fact, according to what the deceased's husband reported, the professor said, when the doctor in charge informed him that he would remove his wife's uterus, she was already dead from uncontrollable bleeding, a fact which was hidden from him.

The deceased's husband also stated that when he entered the operating room he saw that everywhere was filled with his wife's blood, a fact that confirms the uncontrollable and uncontrollable bleeding.

They are seeking criminal prosecution

The victim's family, through their lawyer who tried the death investigation, immediately after the finding addressed a letter to the Attorney General and forwarded the request of his clients for criminal prosecution of all the doctors involved and the legal entity in the clinic. More specifically, it suggests the possible commission (a) of the crime of manslaughter by causing death by unlawful act or omission, (b) the crime of causing death by reckless, reckless or dangerous act, and (c) of criminal recklessness and negligence.

According to non-information, after the conclusion of the Death Investigation, the Attorney General requested on 19/1/2016 the investigative file of the case from the Chief of Police.

Speaking at some stage of the court proceedings, the plaintiffs' lawyer stated, among other things, that: "As a society, we must support the moral and honest struggle of the family for the full elucidation of the causes of death of the undefeated. After all, we must recognize and respect at least the right of her three orphaned minor children to learn the whole truth about their mother's death. At the same time, we must demand from all the competent Authorities, whether they are the Police and the Legal Service, or the Ministry of Health, or even the Medical Association, to fully investigate such cases and seek the punishment of the responsible doctors where and where they should be. After all, the events of this tragic case, as recorded by the Death Investigator, speak for themselves ".
