Convictions for violations of the Occupational Safety and Health Legislation imposed by the Famagusta District Court within 2021

Within the scope of its competence, the Labor Inspection Department of the Ministry of Labor, Welfare and Social Insurance promoted the criminal prosecution of Employers and Company Managers, who violated the provisions of the Legislation, which concerned issues of Occupational Safety and Health.

As a result of these prosecutions, the Famagusta District Court convicted in 2021 the following persons, which were officially published by the Government:

This announcement:

1. The company "MA PETINOS ESTATES LTD", which is active in the construction sector, in a total fine of € 5.000, for the following violations, of the Occupational Safety and Health (Minimum Specifications for Temporary or Movable Construction) Regulations, of Occupational Safety and Health (Notification of Accidents and Dangerous Incidents) Regulations, the Compulsory Employers' Liability Insurance Laws and the Occupational Safety and Health Laws, which caused the serious injury of an employee as well as put at risk other persons:

(a) Failure to install solid railings at the edges of the floor with sufficient height, at least 1,10 meters from the floor, to have a shield or other obstacle at floor level of at least 0,15 meters, a handrail and a horizontal element so that the distance between a chest or other obstacle and a handrail or other horizontal element not to exceed 0,45 meters or to use other equivalent means to prevent persons from falling from a height, resulting in an employee falling from a height of 3,60 meters and being seriously injured .

(b) Failure to comply with an Improvement Notice, issued to it by a Labor Inspector, for failure to comply with its provisions on occupational safety and health Legislation, within the time limit specified therein.

(c) Failure to send to the District Office of Labor Inspection of Famagusta, written accident notification, submitting appropriately and fully completed the approved notification form regarding an accident that occurred to an employee during his work and which made him incapable of work for more than three calendar days excluding the day of the accident.

(d) Failure to insure its liability against an accident or occupational disease to any of its employees.

(e) Failure to ensure the preparation of a safety and health plan prior to the commissioning of the site, which is adequate and appropriate to the particular hazards, and the specific conditions of the project, to be determined, based on written risk assessments , specific measures including working methods, organizational and technical measures and other arrangements for managing and dealing with the risks involved in the various phases, activities and jobs of the project for the protection of persons at work and / or other persons that may be affected.

2. The company "TLM HOTELS LTD", which is active in the field of hotel management, in a total fine of € 1.800, for the following violations, the Regulations on the Management of Safety and Health at Work Regulations and the Laws on Safety and Health at Work , which endangered its employees as well as other persons:

(a) Failure to implement an appropriate security or risk management system describing, inter alia, arrangements for the effective planning, organization, control and monitoring and review of preventive and safeguard measures to be taken for workplace activities that involve risks.

(b) Failure to provide a written assessment of the risks arising from its activities, with the result that employees and other persons are exposed to risk due to the untimely identification and assessment of risks as well as the failure to take the necessary preventive and protective measures.

(c) Failure, as far as is reasonably practicable, to install suitable protective curtains of a height of 1,10 m or to secure in another suitable manner where there was a risk of falling from a height of more than two meters, resulting in exposing a person to a risk of falling beyond 10 m.

3. A manager with a total fine of € 900 for violations of the provisions of the legislation on safety and health at work.
