After five years of offering at Rizokarpaso High School, as a Physics teacher and despite her installation in the ancestral home in Agia Triada, Panagiota Hatzigianni, was notified by EVS with a letter 5/12/18 that her service is terminated and she becomes unemployed, retroactively from 6/10/18 because the illegal occupation regime refuses to accept the continuation of her employment there.
The applicant, who served indefinitely, believes that in essence the official State can not depend on the due good administration, good faith and consistent attitude towards teachers who employ from the wishes of an illegal regime. This attitude is a punishment again imposed on her without even being heard. That is why he appealed with the lawyer of Andrea S. Angelidis to the Administrative Court asking that the said decision be declared invalid and without result.
Her appointment with a "contract" made by EVS was made because it is provided by the Law itself, which provides for the filling of positions and / or needs of the Public Education Service on a permanent or temporary basis. Obviously the educational needs in the whole territory and therefore for the Rizokarpasos High School allow temporary contracts according to the Law on Educational Service, with the consequence that this five-year service of the Applicant is an acquired in favor of the public right owed by the State to required by the Constitution (Article 35).
EVY, even if it had to for "political" purposes (which is unacceptable) not to react to this arbitrary action of the illegally present in the Republic of Cyprus militarily and with occupier settlers, had to respect the 4th Transnational action of Cyprus against Turkey, to maintain in favor of the Applicant the status of her indefinite employment. In other words, the Applicant should have continued her work in the free areas or in another job in the ministry, but instead instead illegally chose to punish the Applicant additionally, making her unemployed. Unemployed due to its excellent five-year offer.
