At 50% the support from KD to ECHR

vfs Famagusta, ECtHR, Republic of Cyprus

The Republic of Cyprus informed the ECtHR about the decisions taken in relation to two cases before the Court concerning Greek Cypriot property in the occupied territories. According to the relevant correspondence, the Republic of Cyprus does not intend to follow the same stance in both cases and will provide support to only one. The case that won the support of the Republic of Cyprus is the one that concerns properties in the enclosed area of Famagusta. The second case that will be dealt with by the ECtHR and which concerns Greek Cypriot properties in the occupied Tympos did not happen to the same fate.

The European Court of Human Rights informed the parties that "by letter dated 22 October 2019 the Government [of the Republic of Cyprus] has informed the Court that it wishes to take part as a third party in the proceedings of the Court concerning the case" KVMediterranean Tours Limited v. Turkey ». It is also stated that after receiving the letters, the time of submission of the remarks by the Cypriot government will be decided. It should be noted that in this case, Turkey has already asked the ECtHR for an extension, which it received and will have to submit its observations by December 16th.

The second case concerns the case of 'Panagi and Shiartou v. Turkey ”and which has to do with property rights in the area of occupied Tympos. In its letter, the Republic of Cyprus informs the ECtHR that it "does not intend to exercise the right granted to it under Article 36 of the Treaty to intervene in the proceedings of the Court". For this case, Turkey requested and received an extension to be placed until December 17.

Commenting on the above developments, the lawyer of the cases, Achilleas Dimitriadis, is particularly caustic regarding the decision of the Republic of Cyprus to support the case of Famagusta and not the province of Nicosia.

In a statement to "F" he expresses his satisfaction that "finally the Republic of Cyprus referred to the Court" emphasizing that it will participate in one of the two cases. Continuing, Achilleas Dimitriadis said that "the pleasant thing is that he will support the applicants in the case of the enclosed area of Famagusta". At the same time, she expressed the hope that KD "will defend the property certificates that it issues to its citizens".

He described it as "sad, because in his wisdom the state decided not to participate" in the second case that is for properties in the occupied Tympos. According to Ah. Dimitriadis, "this does not help this case especially in terms of estimates, but adversely affects all other cases in the ECtHR." He concludes that "human rights are not a carte blanche and (the state) should support all its citizens equally." Finally, he noted that this is the second case in the ECtHR that the Republic of Cyprus behaves in a similar way. The case of Ioannou, which concerned real estate in the occupied Coma of Gialos, had preceded.
