Greece: Six months in prison for using emoticon on Facebook!

The Single-Member Misdemeanor Court of Volos imposed a sentence of six months in prison on a resident of the city, for using a smiley emoticon on Facebook. This decision creates the first doomed to use emoticon on Facebook, in Greek courts.

Specifically, the Single-Member Misdemeanor Court ruled that the accused, with his specific post, violated the precautionary measures imposed on him when a professional in the area sued him for defamation. Then, again by decision of the Single Member Misdemeanor Court of Volos, Voliotis was forbidden to refer directly or indirectly to the professional.

When on February 2, 2017, the professional posted an advertisement of her business on her personal Facebook page, the defendant "commented" under the post with a smiling emoticon.

During the trial, the court ruled that the specific emoticon under the post of the professional is offensive and derogatory, as well as that it constitutes a violation of the precautionary measures imposed on the defendant.
